Child custody issues can be such a problem when a divorce is imminent. There are many factors that enter into why and who will remain with the custody of the child or children. If a marriage results in multiple children, a court has the authority to split the custody between the parents in accord and separate the children with the best interest of each particular child. But usually the best interests of a child will be to live with that child’s siblings, in part for reasons of emotional support. Regardless of which parent remains with full custody the parent without full custody will still have rights to see their child or children. The non-custodial parent maintains the right to see and visit their child, absent extraordinary circumstances. If the court’s custody decree does not cover visitation then the law implies the parent’s right for visitation.
